Terms of Service
Definitions
Owner means a user offering a parking space. Seeker means a user looking for or booking parking. BRF means a Swedish housing association.
1. About SpotBuddy
SpotBuddy is a digital service for listing, booking and managing the sharing of parking spaces between users. The service is aimed at people who want to offer a parking space ("Owner") and people who want to book a space ("Seeker").
SpotBuddy provides the platform and associated features. The actual use of a parking space is conditional on the person offering the space having the right to do so, and the person booking it complying with the applicable conditions.
2. Who may use the service
You must provide accurate information and only use the service for legitimate purposes. If we offer verification or other security features, you must not attempt to circumvent them.
If you use the service on behalf of someone else, you are responsible for having the right to do so.
3. User obligations
All users agree to:
- Provide accurate and truthful information when registering.
- Use SpotBuddy only for its intended purpose — finding, offering or managing parking.
- Not engage in fraudulent, offensive or illegal activity on the platform.
- Not resell or transfer bookings to third parties.
BRF connection
- Joining a BRF in SpotBuddy is intended for residents of that BRF and persons with a formal connection to it.
- A user can only be linked to one home BRF at a time.
- When you join a BRF, you confirm that your residency information is truthful and that any information you provide about the BRF is accurate to the best of your knowledge.
- If you leave a BRF, your residential access to that BRF ends. Ongoing bookings for residential spaces may continue until the booking end time, but upcoming bookings for residential spaces may be automatically cancelled.
- Parking spaces you have listed and linked to the BRF may be deactivated or disconnected when you leave, so they are not booked based on incorrect assumptions about residential access.
Seekers also agree to:
- Follow all access instructions provided by the Owner.
- Arrive and leave within the booked time period.
- Treat the parking space and surrounding property with care.
- Respect rules from the BRF, property association, landlord or other local area where the space is located, as well as other residents.
Owners also agree to:
- Only advertise parking spaces they legally have the right to rent out.
- Ensure that access instructions are accurate and up to date.
- Clearly specify any restrictions, conditions, access rules and local regulations before booking.
- Ensure that each listed space includes free time slots in accordance with the service's publishing rules.
4. Bookings and payments
If SpotBuddy offers payment features, payments and payouts may be processed through an external payment provider, such as Stripe. SpotBuddy does not store full card details.
The price shown to the Seeker before booking is the price the Seeker pays for the booking, unless otherwise clearly stated. SpotBuddy may charge a fee by deducting it from the payout to Owners. Payout terms may also depend on the payment provider's terms, procedures and risk controls, and the specific booking. See Stripe's terms for service providers for more information on how payments are handled.
A booking is not finally valid until it has been confirmed in accordance with the flow applicable in the service. SpotBuddy does not guarantee that a request will be accepted or that a space will always be available.
Listed spaces must include free time slots as part of the service's publishing rules, and this must be stated in the listing and booking flow.
Income from rental may be taxable and the rules vary depending on how the parking space is linked to the residence and the arrangement. You are responsible for checking what applies to your situation.
5. Cancellation policy
The cancellation and refund rules applicable to a booking shall be stated in the service when the booking is made. Different types of bookings or campaigns may be subject to different rules.
If an Owner cancels a confirmed booking or if a space does not match the description, SpotBuddy may decide on appropriate measures in accordance with the policy applicable at the time, such as a refund, credit or account restriction.
6. Local rules, permits and tax
SpotBuddy is not responsible for ensuring that a particular rental is permitted under rules from the BRF, property owner, landlord, property association, municipality, road or area association or any other third party. The person offering a space is responsible for checking this before the space is published.
If a listing is incorrect, misleading or published without the necessary right or permit, the user who published the listing is responsible for the consequences. This includes, for example, penalty charges, parking fines, towing, claims from third parties or other costs arising from incorrect or unauthorised information.
VAT on parking spaces. The Swedish Tax Agency (Skatteverket) has changed its position on when parking space rental linked to a residence can be exempt from VAT. According to Skatteverket's current public guidance, the changed interpretation starts being applied on its own initiative from 1 October 2026. The Swedish government has also launched an inquiry, which means the legal position may change.
The exemption still depends on three conditions being met: the parking must be close to the residence, the tenant must be unable to opt out of it in the agreement, and the tenant must not sublet the space in an economic activity. If you rent out your parking space through SpotBuddy, that can affect how your BRF or landlord assesses the VAT question in relation to your parking arrangement. SpotBuddy is not responsible for users' VAT or tax assessments.
SpotBuddy does not provide legal or tax advice. Information in the service is general and does not replace advice from, for example, the Swedish Tax Agency, a lawyer, an accountant, or another qualified adviser.
7. Prohibited use
The following is strictly prohibited:
- Using a parking space for any purpose other than parking private vehicles.
- Providing false or misleading information in listings or profiles.
- Knowingly circumventing the platform by moving a booking or payment outside SpotBuddy after the contact or booking opportunity arose through the service.
- Harassment, threats or offensive communication directed at other users.
8. Disputes and support
In the event of a dispute between Owner and Seeker, the parties should first try to resolve it directly. If that is not possible, contact SpotBuddy at support@spotbuddy.se.
SpotBuddy may in certain cases assist with information or mediation based on the material available in the service, but we cannot guarantee that all disputes can be resolved by us. If mandatory consumer law or other legislation gives you additional rights, these take precedence over these terms.
If we cannot resolve the dispute, you as a consumer may turn to the National Board for Consumer Disputes (ARN). The EU Commission's online dispute resolution platform can be accessed via ec.europa.eu/consumers/odr.
9. Account suspension
SpotBuddy may suspend, restrict or terminate an account if the user violates these terms, acts fraudulently, puts others at risk or uses the service in a way that could harm the platform or other users.
Where possible, we will inform you of the action in advance or close to when it is carried out.
10. Limitation of liability
SpotBuddy is not liable for indirect damage, lost profits or damage arising from the actions of users, lack of authority to rent out a space or incorrect information in a listing.
SpotBuddy does not mediate or compensate for penalty charges, parking fines, towing, clamping, access problems or other costs arising because a space was incorrectly described, was not permitted to be rented out or was used in breach of local rules, unless liability follows from mandatory law.
SpotBuddy is also not liable for damage to vehicles, property or persons arising in connection with the use of a parking space, unless otherwise required by mandatory law.
If SpotBuddy incurs costs or claims from third parties as a result of a user having provided incorrect information, lacked the right to advertise a space or otherwise breached these terms, the user may be required to compensate SpotBuddy for such costs to the extent permitted by applicable law.
Nothing in these terms limits liability that may not be limited by law. For consumers, mandatory consumer protection rules always take precedence over any conflicting contractual terms.
11. Changes to these terms
SpotBuddy may update these terms as the service changes or as required for legal or technical reasons. The latest version is published on the website. In the event of material changes, we will endeavour to provide clear notification.
12. Governing law and contact
These terms are governed by Swedish law, taking into account mandatory consumer protection rules. SpotBuddy is currently operating in formation. Upon formal incorporation, rights and obligations under these terms will automatically transfer to the registered company without any action required from the user.
